Duijndam Uitzendgroep is active in the field of labour and job placement and processes personal data in that context. In this privacy statement we explain which personal data we collect and use, as well as the purposes for which and the grounds based on which we do this. In addition, we specify for how long we retain your personal data, whether we share this data with third parties, how your data has been protected, and how you can contact us.

If you provide personal data to us as a job applicant, employer or client, we will store and process this information in accordance with this privacy statement, unless indicated otherwise. We will always process your data with due observance of the General Data Protection Regulation and other applicable regulations with regard to the protection of personal data.

2. Controller
Duijndam Uitzendgroep is responsible for the processing of your personal data and is established at Kerklaan 51 in (2291 CE) Wateringen.

3. Visit to the website
You can visit our website without personal data being provided to us.

Like many other websites, this website automatically collects certain technical information about the users of the website, so-called cookies, such as the IP address of your computer and the date and time of your visit, in a form that cannot be traced back to the individual user. These cookies are necessary for the proper functioning and the management of the website. We currently do not use cookies and similar technologies for which your consent is required. We do use Google Analytics cookies. We have concluded a processing agreement with Google for this purpose. We have disabled data sharing, we anonymise your IP address and have not provided Google with permission to share your data with others. We do not use other Google services, whether combined with Google Analytics or otherwise.

Our website may contain referrals and/or hyperlinks to one or more third party websites. This privacy statement does not apply to these websites. We recommend that you read the privacy statement of these third parties, to learn how they handle your personal data

4. Why we collect personal data
We collect and process your data for the performance of our services, such as: placement and secondment, recruitment and selection, job coaching, HR consulting, the sickness absence policy, outplacement, payrolling, and salary administration.

To be more specific, we process your personal data:

  • to be able to make you offers and/or provide information about our services and further tailor these to your requirements and qualities;
  • to approach you for commercial offers, newsletters and promotions that might be of interest to you, only if you have registered for this (opt-in);
  • to be able to assess your suitability and availability in connection with intermediary services geared towards permanent or temporary employment or an assignment, which may include the use of results, reference checks (whether by engaging third parties or otherwise), etc.;
  • to enter into and maintain an employee or staffing/ intermediary relationship with you and to conduct the administration relevant for this purpose;
  • to meet our rehabilitation obligations and to provide work for people with (to a different extent) poor job prospects;
  • to record an assignment at the client in an agreement with the client and to maintain and fulfil the agreement with the client;
  • to enhance your personal development and employability, including training, courses, and testing;
  • for management purposes including management information, carrying out internal checks and occupational safety and carrying out internal audits and accounting audits;
  • for quality purposes such as certification;
  • to apply for subsidies, premium reductions and suchlike;
  • if we have entered into an employee or staffing/intermediary relationship with you, for compliance with legislation and regulations, including but not limited to identification, labour legislation, tax and social security legislation, combatting fraud, and national and international sanctions legislation.

We process your personal data on the basis of one or more of the following grounds:

  • Necessary for the performance of the agreement
  • Necessary for looking after legitimate interest
  • Necessary for compliance with a statutory obligation
  • Your consent (if required)

We do not use automated decision-making or profiling, nor are you under any obligation to share personal data with us. However, this may result in our being unable to offer you our best services.

5. Which data of you we collect
You are personally responsible for the accuracy and relevance of the data you provide to us. More specific, the following personal data is processed insofar as relevant and necessary: name and address details (name, address, town/city), email address, telephone number, nationality, date and place of birth, gender, civil status, curriculum vitae (cv), work experience, clothing sizes for work clothing, bank account number, health insurance policy or client number, training course and education details, (copies of) certificates, references, (copy of) passport photo, (copy of) proof of ID, citizen service number (Dutch BSN), (copy of) work permit, (copy of) employment agreement, (copy of) residence permit, (copy of) Declaration of Independent Contractor Status (Dutch VAR), your height, and any allergies and/or fear of heights.

The following personal data of our clients and business relations is processed: (business) name and address details (name, address, place of business or town/city), email address, details necessary for maintaining the relationship, position and contact details.

We can pass on your personal data to (potential) clients and relations, suppliers (e.g. educational institutes), audit bodies, government bodies, subcontractors and to businesses and/or persons we have engaged for the performance of certain duties (including processors). We do this if it is necessary for achieving the purposes referred to in this privacy statement. In addition, we can provide your personal data to third parties if we are entitled or obliged to do so pursuant to applicable legislation and/or regulations or a court order or a judgment, or as the case may be we have obtained your consent for this.

6. Special personal data
We only process special personal data if this is necessary for meeting our legal obligations, insofar as explicit consent has been given, or insofar as this is otherwise allowed under or pursuant to the law. ‘Special personal data’ are taken to mean data concerning racial origin, religion or beliefs, political opinion, health status, sex life, trade union membership, criminal personal data and/or personal data about wrongful or objectionable behaviour.

7. How long your data is retained
We do not retain your personal data longer than is necessary for the purposes for which this data was collected and observe the laws and regulations in this regard. From time to time, we check whether the personal data still needs to be retained.

8. Security and confidentiality
We consider it important that your personal data is adequately protected. We therefore take appropriate precautions to protect your personal data against loss or any form of unlawful processing and require third parties that handle or process your personal data on behalf of us to act in the same way, regardless of whether these processing operations take place in the Netherlands or elsewhere. These precautions include both technical and organisational measures. Technical measures include inter alia physical security and password protection. Organisational measures include, for example, limiting of access to qualified staff with a duty of confidentiality. The precautions taken warrant an appropriate level of security, taking into account the risks of the processing and the nature of the data to be protected.

Third parties that we provide your personal data to are themselves responsible and liable for their actions and have to ensure themselves that they comply with the applicable legislation and regulations. We are neither responsible nor liable for the processing of your personal data by engaged third parties. If a third party is engaged for the processing of personal data, however, we always make sure that a processing agreement as referred to in the GDPR has been concluded with the relevant party. We never allow a third party to share your data with others.

When applicable, the personal data is only transferred to countries outside the European Union if these countries offer, in conformity with the relevant legislation, an appropriate level of protection for the processing of personal data, for example, the US/EU Privacy Shield, if the transfer is necessary, and if one of the grounds referred to in this agreement offers this possibility.

9. Access, correction or removal
You have the right to access the personal data we have of you both in the personnel and absenteeism file, and you can ask us to correct, revise or remove and/or block completely the personal data you have provided to us. If a processing operation is based on your consent, you are entitled to withdraw this consent at any time (without retroactive effect). You are also entitled to request a data export of your personal data, to object to the processing of your personal data (if substantiated), request a restriction of the processing of your personal data (also if substantiated) and to lodge a complaint with a relevant privacy supervisor (the Dutch Data Protection Authority in the Netherlands). We will respond to your request within 1 (one) month.

10. Questions, comments and complaints

We may amend this privacy statement from time to time by placing an updated version on the website. We recommend that you check this privacy statement on a regular basis to stay informed of the current policy with regard to personal data. If you keep using this website, this means that you have accepted these amendments.
